General terms and conditions

These conditions have been drawn up in order to clarify the use of all information provided by me (hereinafter referred as 'Love Letter To Myself', abbreviated to LLTM) via or in connection with this website and also apply to all agreements made between LLTM and you (hereinafter referred as Client).

Intellectual property on texts and photos on the website

The use of the information on this website and the manual for writing a Love Letter or Love Poem that can be obtained via this website is free of charge as long as the Client does not copy, distribute or otherwise makes further use this information. The intellectual property of the texts and photos on this website, or that you have obtained through this website rests to LLTM, with the exception of the photos with the wax seal and the two people (iStock) and the photos with the writing hand, the portrait photo and photo with the cappuchinos (Agnes Mertens).

The intellectual property of the design, source code and architecture of the website lies with Brigaid.

The (re)use of all these materials, is only allowed if explicit written permission has been granted.

Intellectual property Love Letter

From the moment that the Client receives a Love Letter that LLTM has written on behalf of the Client , the Client is permitted to copy, distribute or publish this letter at his or her own discretion.

The intellectual property remains with LLTM. LLTM retains a digital version, but shall not share the content of the Love Letter or any part of it with third parties, nor shall LLTM distribute it in any form without the express written permission of the Client. (See further under 'Privacy').

Cancelling or changing appointments

Via this website, an appointment can be made for an interview to prepare a Love Letter or for an online coaching.

If the Client wants to cancel or change the appointment, the following applies.

Online coaching: cancelling/changing free of charge, up to 24 hours prior to the interview.
For an online coaching session, the Client can cancel or change the appointment free of charge up to 24 hours prior to the session. In that case, the Client is entitled to a full refund for the amount that has been paid in advance for this conversation. If the Client, within 24 hours prior to the call, cancels or wishes to move the appointment to another date, the Client shall owe the full amount.

Conversation for a Love Letter: cancellation/change free of charge, up to 48 hours prior to a call.
For an online call that serves as input for a Love Letter, the Client can cancel or reschedule the appointment free of charge, up to 48 hours prior to the call. LLTM uses a longer period for this than for a coaching call, because LLTM reserves ample time to compose the Love Letter.
If a cancellation or change is made up to 48 hours prior to the interview, the Client is entitled to a full refund for the amount that has been paid in advance for this conversation.
If the Client cancels within 48 hours prior to the interview or if the Client wishes to move the appointment to another date, the Client shall owe the full amount.

Cancellation is understood to mean unsubscribing in writing (by e-mail) and/or not appearing at an (online) appointment, regardless of the reason.

Appointment is not personal.
The appointment made by the Client with LLTM is not personal. The Client may at all times decide to transfer the appointment, made for online coaching or for a Love Letter, to someone else.

Cancellation by LLTM

If an online coaching interview is cancelled or changed within 24 hours due to the actions of LLTM, and for an interview for a Love Letter within 48 hours, the Client is entitled to a full refund of the amount that is payed in advance for this conversation.

LLTM may cancel sessions due to illness or other reasons. The Client cannot derive any rights from this.

Payment obligation

After making an appointment for an interview for a Love Letter or for online coaching, LLTM sends an invoice to the Client under the name of Heart Based Consciousness. The payment term is 14 days, but if the interview takes place within 14 days after making an appointment, the full amount must be in the account of Heart Based Consciousness prior to an interview.

If payment has not taken place prior to the moment an interview takes place, LLTM can decide not to continue the interview and to postpone it to a later date. The Client remains obliged to fulfil his payment obligation under the conditions described for cancelling or changing appointments.

Refunds

LLTM guarantees that it will do its utmost to align itself as closely as possible with the Client in both the online conversation and the writing of the Love Letter. The aim of LLTM is to formulate the Love Letter in such a way that the Client feels reflected in it.
If the Client is not satisfied with the conversation and/or the Love Letter, LLTM cannot grant a refund.

If the Client has entered into a payment obligation for a Love Letter, but decides after the online conversation to renounce the Love Letter for whatever reason, no refund will be granted.

Privacy

LLTM respects the privacy of the Client. LLTM shall process the Clients personal data in accordance with the applicable privacy regulations and the privacy statement available on the LLTM website. The Client agrees to this processing of their personal data.

With regard to a Dutch-language Love Letter, LLTM guarantees that the content of the Love Letter addressed to the Client, or part of that content, will not be shared with third parties. LLTM may only deviate from this if the Client has given its express written consent.

With regard to an English-language Love Letter, LLTM shall proceed as follows.
After LLTM has written the Love Letter in English, LLTM shall anonymise all data that can be traced back to the Client and have the anonymised letter corrected by a translator. This is done to ensure the quality of the English language. LLTM has a binding agreement with this translator that data from the Client’s Love Letter may not be shared with third parties.
After correction, LLTM returns all personal data to the letter and sends it to the Client. LLTM guarantees that the content or part of the content will not be shared with third parties. LLTM may only deviate from this if the Client has given express written permission to do so.

Image and sound recordings
LLTM makes an image and/or sound recording of the conversation with the Client if the conversation is a preparation for writing a Love Letter. LLTM uses this material only as input for the Love Letter. LLTM guarantees that this recording will be destroyed immediately after the completion of the Love Letter.
The Client cannot make any claim to this recording, unless expressly agreed otherwise in writing.

Liability

LLTM shall never be liable for any direct or indirect damage suffered by the Client or third parties, including consequential and immaterial damage as a result of using or not using LLTM's services.
